Tax rebel takes on the council
A COUNCIL-tax rebel is refusing to pay until Mole Valley answers six questions he has put to them.
David Bark, of Dorking, was summoned to Redhill Magistrates' Court over an outstanding bill of nearly £2,500 but, after he failed to appear, a warrant has been issued for his arrest.

Police have yet to receive the warrant but David is defiant and refuses to pay while his questions remain unanswered.
He said: "I have not once stated that I will not pay council tax.
"It is in letters, in writing, that I conditionally accept council tax on the conditions that they answer my questions."
The dispute centres around David's assertion that he is not Mr David Bark, the recipient of the council tax bills, but "David – Andrew: of the family Bark".
He claims that Mr David Bark is a legal entity, created by the state and personified by his birth certificate, and that he has no obligation to represent it.
As a result David has sent a list of six questions to the council, asking them to prove he is in a contract with them, that they have explained what he is paying for and that council tax itself is lawful.
He said: "All I want to do is get my point across.
"What is so hard about answering the question: 'Is council tax lawful?'
"It is not a hard question.
"All I wanted was an itemised bill showing what services I am paying for and they haven't done that.
"What makes a company have the right to demand money from someone without full disclosure of what they are paying for?"
David has been summoned to court three times since May last year, most recently last Thursday, in relation to the outstanding bill but refuses to attend until the council meets his demands.
Having researched law for the past two years, David believes he is no longer a member of society and therefore no longer subject to its laws.
He has sent a letter to the Queen saying that he removed himself from society and will govern his own life and has subsequently declared himself a "Freeman on the Land".
He said: "Civil law is a legal rule of society which is given force of law by the consent of the governed.
"If you are no longer a member of that society, they can't enforce their rules on you."
He added: "I have sworn an oath to keep the peace and that's what I will continue to do because I am a peaceful man and I have no ill will to anyone."

“Dave, nice try but if you want to aviod paying taxes just claim asylum
but your taxes dont just go on paying for things you use today it pays for the past (we have only just finished paying the yanks for the WW2 lend lease ships etc) otherwise German would be your mother tongue) and for the future - schools for the kids to read/write etc so they can support you in sickness and health when your older and not working.
The fact that it goes to central government or local town hall, it is still the same thing it just makes it easier to manage on a regional level.
Use this apparent spare time you seem to have an excess of by helping charities or local groups or the homeless as you know where this can only ever end.
Why dont you travel the 3rd world and see what a country is like when it doesnt have an organised structure, where people die of hunger and even in places like major chinese cities you see people eating out of the bins.!

“Thanks for that info David A. you are infact correct in what you say, however a proportion of that "Vehicle Excise Duty" is supposed to go to the upkeep of the highways but if you would care to take a trip to Cumbria the entire road network is in disrepair and crumbling fast, there are many stretches of road around me that are so bad it is like driving on a dirt track, last December (Maryport / Cockermouth / Workington) were isolated after the floods brought down all the vital road bridges or left them in a dangerous state of repair, today January 12th 2011 we are still having to rely on a makeshift bridge while yet another is still closed and not due to open until the spring, the roads continue to be patched only instead of re-layed and are breaking up faster than they can repair them, so what I would ask is where is all the money for the infrastructure going? and why should I pay for a service I am NOT receiving.

“Dave Blues, sadly the thing that you think is road tax to use the roads is no such thing. It's a tax on the vehicle, hence "Vehicle Excise Duty". Strangely enough, some of the council tax is meant to go towards the upkeep of the roads.”

“In answer to Gazz, Dorking I don't know what services David A Bark is using but I can tell you that I do not use any services that I haven't already paid for, see my post Dec 10th, but like David A Bark I have been given the same run around by the local council in Cumbria who have not yet answered my questions, they have however issued a false document perporting to be from a Magistrates court and a subsequent Liability order - both of which I have proven are fraudulent, I have now challenged my local council to prove their claim on me before I take them to court on a charge of harrasment with deception and attempt to defraud also on a further charge of Perjury under the 1911 perjury act link provided.

“Some points worth noting.
'Lawful' is what it is all about. 'Lawful' .vs. 'unlawful'. Do not get trapped into discussing 'legal'/'illegal'.
The law can give rise to a FICTION, but a fiction cannot give rise to a law. Consequently a legal fiction called THE GOVERNMENT has no power to make LAW. It is, in point of fact, BOUND BY LAW (like everyone else, and including all other legal fictions). PARLIAMENT is another legal fiction entity. Statutes created by Parliament are not, therefore, the LAW. They are 'legislated rules for a society' and ONLY APPLICABLE TO MEMBERS OF THAT SOCIETY. Join a different society, and you would be bound by a different set of rules. (If this were not the case it would be impossible to become, for example, a Freemason and be bound by the rules of Freemasonry). Statutes are nothing more than the Company Policy of THE UNITED KINGDOM CORPORATION.
Only a sovereign flesh and blood human being, with a living soul, has a Mind. Only something with a Mind is capable of devising a CLAIM. Legal fictions are soulless, and do not possess a distinct Mind. They cannot, therefore, in LAW, make a CLAIM.
Contractual obligation. For ANY contract to be lawful, INCLUDING A CONTRACT BETWEEN YOURSELF AS PLAINTIFF OR DEFENDANT IN A COURT DE FACTO, it must comprise the following:
¿ A) FULL DISCLOSURE by both parties. Neither party can later claim 'you should have known' if it was not specifically declared at the time of making the contract.
¿ B) A CONSIDERATION offered by both parties, this being the subject of the exchange. It must be a sum of money, or an item of value. Both parties agree that their CONSIDERATION is worth (to them) the other party's CONSIDERATION.

This is the choice we make like David A Bark I too made a choice and decided to ask what I was paying for, as NO reply was given I stopped paying this Unlawful Tax, if the rest of you wish to continue then that is YOUR choice and I will not condem you for that - So before you start to condem us please find out ALL the facts before you make a fool of yourselves.
