'No speed warning' says driver in court

A former councillor has appeared in court to continue his fight against a speeding charge he received on a busy Mole Valley road.

Julian Shersby, 46, of Grenehurst Park, Capel, appeared at magistrates' court for a second time on Monday to face an allegation that he drove a Toyota car 15mph over the speed limit on the A24 Mickleham bypass.

Shersby, who was a Mole Valley District Councillor for Capel, Leigh and Newdigate until 2006, pleaded not guilty to the offence in May.

Prosecution counsel claim Shersby was caught travelling at 65mph in a 50 zone in July last year by a police officer using a laser speed gun.

Taking to the stand at Crawley Magistrates' Court, Shersby admitted to travelling past that point, but is arguing against the charge on a technical point.

He claims there are no road signs informing drivers coming from the unrestricted speed limit in Swanworth Lane and Norbury Park on to the 50mph restricted section on the A24.

He argued that this breaches a traffic regulation order even though he said he didn't drive from either road onto the A24.

He said: "I had done a number of trips to London during that week and to reach junction nine of the M25 I would have passed that point.

"I am aware the speed limit changes a lot on the road. I think it changes about five times. It appears that I would have passed a 50 [mph] sign."

The 46-year-old said he didn't think he was speeding and added: "I was travelling along the road in a normal, orderly fashion."

However, Celia Record, prosecuting, said: "You should have adjusted your speed, but you didn't and therefore you are guilty of speeding on that day."

At a previous hearing the trial heard evidence from PC Ian Kyle, of the Surrey Safety Camera Partnership.

He said his equipment was in full working order and checks had been carried out in the morning of July 3, 2008 – the day he said he caught Shersby exceeding the speed limit.

He told the court his mobile enforcement van had been parked on the central reservation between the northbound and southbound A24 carriageways opposite Givons Grove.

District Judge Roger Ede adjourned the case until next month when he will give his verdict.
